Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Ronnie H. Handley, Jr. and Cheryl Handley, husband and wife, to Mortgage Electronic Registration Systems, Inc., as a nominee for Novastar Mortgage, Inc., on January 20, 2006, said mortgage being recorded in the Office of the Judge of Probate of St. Clair County, Alabama, at Book 2006, Page 4056; and subsequently transferred to The Bank of New York Mellon, as Successor Indenture Trustee under Novastar Mortgage Funding Trust, Series 2006-1; and subsequently transferred to The Bank of New York Mellon, f/k/a The Bank of New York as successor in interest to JPMorgan Chase Bank, N.A. as Indenture Trustee for NovaStar Mortgage Funding Trust, Series 2006-1, NovaStar Home Equity Loan Asset-Backed Certificates, Series 2006-1; The Bank of New York Mellon, f/k/a The Bank of New York as successor in interest to JPMorgan Chase Bank, N.A. as Indenture Trustee for NovaStar Mortgage Funding Trust, Series 2006-1, NovaStar Home Equity Loan Asset-Backed Certificates, Series 2006-1, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the St. Clair County Courthouse, in Pell City, Alabama, on December 21, 2017, during the legal hours of sale, the following described real estate, situated in St. Clair County, Alabama, to-wit:

Lot 82, according to River Oaks Subdivision, as recorded in Map Book D, Pages 72 through 76, in the Office of the Judge of Probate of St. Clair County, Pell City, Alabama; located in the NW 1/4 of the NE1/4 of Section 2, Township 18 South, Range 3 East.

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expense of foreclosure.
