The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 15, 2005, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Document No. 200500011193, in Book No. 842, at Page 101, and reformed by Court Order in Document No. 201700015924, in Book No. 47, at Page 98, Robert W Saunders and Marcella L Saunders did convey unto James B. Martin and Larry F. Mazza, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated January 19, 2018, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by MVB Bank, Inc., to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse in Fairmont, West Virginia, on

All of Lot No. Twenty-Three (23), in Sub-Division “C Anna Manor”, as shown on said plat of said Subdivision, which is recorded as aforesaid in Plat File No. 1, Map A-59.

Being the same real estate conveyed to Elmer C. Grimm and Mary Ann Grimm, husband and wife, by Community Homes, Inc., a West Virginia corporation, by deed dated August 13, 1996, of record in the office of the Clerk of the

Excepting and reserving from the real estate conveyed herein those certain tracts or parcels of real estate identified as Parcels “B” and “D” as shown on that map entitled Plat of Boundary Line adjustment between Lots 21, 23 & 24, C’ Anna Manor, Section II¬, prepared by Paul D. Harbert, PS No. 862, McCoy Land Surveying Monongah, WV, dated August 1998, of record in the aforesaid Clerk’s office in Deed Book No. 958, at Page No. 1002, being more particularly described by the aforesaid Plat as follows:

Parcel B:

Beginning at 1/2” iron pin found in line of Lot 8 of Cedar Park, corner to Lots 21 and 23; thence with one line of Lot 8 Cedar Park N. 33° 02’ E. 10.00 feet to a 1/2” iron pin set; thence with an arbitrary line through Lot 23 S. 49° 51’ 57” E. 51.32 feet to a point in line of Lots 21 and 23; thence with one line of Lots 21 and 23 N. 61° 04’ 26” W. 51.05 feet to the place of beginning, containing 254.60 square feet and being part of Lot 23.

Being the same real estate conveyed unto Thomas M. Krpicak and Kalypso Krpicak, husband and wife, by a Quitclaim Deed of Exchange dated August 5, 2005, of record in the aforesaid Clerk’s office and being a part of the same real estate conveyed to Elmer C. Grimm and Mary Ann Grimm, husband and wife, by Community Homes, Inc., a West Virginia corporation, by deed dated August 13, 1996, of record in the aforesaid Clerk’s office in Deed book 935, at Page 217.

Parcel D is described by the aforesaid Plat as

Beginning at a 1/2” iron pin found, corner to Lot 23 and 24; thence running S. 35° 00’ W. 10.00 feet to a 1/2” iron pin set; thence with an arbitrary line through Lot 23, N. 55° 26’ 21” W. 53.56 feet to a point in line of Lot 23 and 24; thence with one line of Lot 23 and 24 S. 66° 00’ E. 54.56 feet to the place of beginning, containing 267.80 square feet and being part of Lot 23.

Being the same real estate conveyed unto Gregory Peter Spiker and Dawn Ranae Spiker, husband and wife, by the Grantors by a Quitclaim Deed of Exchange dated April 7, 2004, of record in said Clerk’s Office in Deed Book 994, at Page 119.

The Grantors hereby further grant and convey unto the Grantees those certain tracts or parcels of real estate identified as Parcels “A” and “C” as shown on that map entitled Plat of Boundary Line Adjustment Between Lots 21, 23 & 24 C’ Anna Manor, Section II, prepared by Paul D. Harbert, PS No. 862, McCoy Land Surveying Monongah, WV, dated August 1998, office of said Clerk in Deed Book No. 958, at Page No. 1002, and being more particularly described by the aforesaid Plat as follows:

Parcel A:

Beginning at a 1/2” iron pin found on the western R/W limits of C’ Anna Square, corner to Lots 21 and 23; thence with the western R/W limits of C’ Anna Square S. 40° 00’ W. 10.00 feet to a 1/2” iron pin set; thence with an arbitrary line through Lot 21, N 49° 51’ 58” W. 50.49 feet to a point in line of Lot 21 and 23; thence with one line of Lots 21 and 23 S 61° 04’ 26” E. 51.45 feet to the place of beginning, containing 252.44 square feet and being part of Lot 21.

Being the same real estate conveyed to Elmer C. Grimm and Mary Ann Grimm by Thomas M. Krpicak and Kalypso Krpicak, by Quitclaim Deed of Exchange dated August 5, 2005 of record in the aforesaid Clerk’s office, and being a part of “Lot No. Twenty One (21A)” conveyed to Thomas M. Krpicak and Kalypso Krpicak, husband and wife, by Community Homes, Inc., by deed dated April 3, 1995, of record in the aforesaid Clerk’s office in Deed Book 924, at Page 948.

Parcel C is described by the aforesaid Plat as follows:

Parcel C:

Beginning at a 1/2” iron pin found in line of Lot 7 of Cedar Park, corner to Lots 23 and 24; thence with one line of Lot 7 Cedar Park N. 33° 02’ E. 10.00 feet to a 1/2” iron pin set; thence with an arbitrary line through Lot 24, S. 55° 26’ 21” E. 53.88 feet to a point in line of Lots 23 and 24; thence with one line of Lots 23 and 24 N. 66° 00’ W. 54.54 feet to the place of beginning, containing 269.34 square feet and being part of Lot 24.

Being the same real estate conveyed to Elmer C. Grimm and Mary Ann Grimm, husband and wife, by Gregory Peter Spiker and Dawn Ranae Spiker, husband and wife, by Quitclaim Deed of Exchange dated April 7, 2004 of record in the aforesaid Clerk’s office in Deed Book 994, at Page 119.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 119 C'Anna Sq, Fairmont, WV 26554.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
