NOTICE IS GIVEN to Denise Sizemore; Spouse, if any, of Denise Sizemore; Gary D. Sizemore; Spouse, if any, of Gary D. Sizemore; John Doe, Occupant; Midland Funding LLC; Arrow Financial Services, LLC; LVNV Funding, LLC; Capital One Bank, N.A. aka Capital One Bank (USA) N.A.; United States of America ex rel Internal Revenue Service that on November 15, 2017, at 10 o'clock, A.m., at 2nd floor of the County Courthouse in Tahlequah, Cherokee County, Oklahoma, the Sheriff of said County will offer for sale and sell for cash at public auction to the highest and best bidder, with appraisement, all that certain real estate in Cherokee County, Oklahoma, to wit:



LOT FOUR (4) IN BLOCK TWO (2) OF INDIAN MEADOWS ESTATES, CHEROKEE COUNTY, STATE OF OKLAHOMA, ACCORDING TO THE OFFICIAL RECORDED PLAT THEREOF.

Subject to taxes and tax sales, said property being duly appraised at $68,500.00.



Sale will be made pursuant to an Order of Sale issued upon a judgment entered in the District Court of Cherokee County, Oklahoma, in Case No. CJ-2017-91, wherein HSBC Bank USA, National Association, as Trustee for ACE Securities Corp. Home Equity Loan Trust, Series 2005-HE5, Asset Backed Pass-Through Certificates is Plaintiff and Denise Sizemore and Gary D. Sizemore is/are Defendant(s) to satisfy said judgment in the sum of $48,645.94 together with interest at 8.84% per annum or at the current adjustable rate from September 1, 2016, including late charges, $2,500.00 for attorney's fee, $550.00 advances for title search, and those additional sums advanced for taxes, insurance, property preservation and all costs of this action accrued and accruing.



The addresses of the Defendant(s), Denise Sizemore and Spouse, if any, of Denise Sizemore, and her/his/their unknown successors are unknown to the Plaintiff.
