NOTICE OF SHERIFF’S SALE
IN OBEDIENCE to the Order of the
Chancery Court of Fentress County, Tennessee
in the cases of Phillip A. Clark, Plaintiff vs. Barbara Clark Rogers Docket No. 14-57 and Terry C. Clark vs. Barbara Clark Rogers, Docket No. 14-56, the Sheriff (or his designee) of Cumberland County, Tennessee has been ordered to sell at public auction the one-half interest of Barbara Clark Rogers in and to the hereinafter described tracts or parcels of property.
NOW, THEREFORE, notice is hereby given that I, Casey Cox, the Sheriff of Cumberland County, Tennessee, (or his designee) in obedience with the Orders of the Chancery Court of Fentress County, Tennessee, will on May 10, 2018 on or about 10:00 a.m., at the Cumberland County Courthouse, Crossville, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale. The Bidder shall be required to pay ten (10%) percent down at the sale, with the remainder being due upon approval by the Chancery Court of Fentress County, Tennessee. The said property being real estate situated in Cumberland County, Tennessee, and being more particularly described as follows:
CUMBERLAND COUNTY, TENNESSEE PROPERTY Map 010, Ctrl Map 010 Parcel 018.00 (Fee Simple title) Property address: HWY 127 N 14324, Crossville, Tn.
The following described tract or parcel of land, lying and being in the SECOND CIVIL DISTRICT of Cumberland County, Tennessee, and being more particularly described as follows:
Beginning at a stake in the South boundary line of the A.G. Green 267 acre tract on the East side of U.S. Highway 127 (formerly known as the York Highway, or the Crossville to Jamestown Highway), the Northwest corner of the original tract of which this is a part; thence with said highway, South 29 degrees West 35 poles to a stone on the East side of said highway; thence South 83 degrees 40 minutes East 1181/2 poles to a stake on the East line of said original tract; thence North 3 degrees East with said line 37.6 poles to a stake with spotted oak pointer, A.G. Green’s Southeast corner at the Northeast corner of the original tract; thence North 87 degrees West with the North line of same, 103 poles to the place of beginning, containing 25 acres, more or less.
EXLUDED HOWEVER, THE FOLLOWING TRACTS OF PARCELS OF LAND:
1. Bernice Anderson Clark to Ambrose Cole, et ux, Tract One for 2.74 acres, and Tract Two for 1.94 acres, which Deed is duly recorded in Deed Book 176, Page 144, Register’s Office, Cumberland County, Tennessee.
2. Bernice Anderson Clark to Buford R. Cooper, et ux, Tract one for 2.04 acres, and Tract Two for 2.06 acres, which is duly recorded in Deed Book 176, Page 265, Register’s Office, Cumberland County, Tennessee.
3. Bernice Anderson Clark to James C. Howard, Sr., et ux for 2.09 acres, which deed is duly recorded in Deed Book 176, Page 505, Register’s Office, Cumberland County, Tennessee.
4. Bernice Anderson Clark to Clifford Pugh, et ux, Tract One for 1.96 acres, Tract Two for 1.99 acres, Tract Three for 1.97 acres, and Tract Four for 2.01 acres, which deed is duly recorded in Deed Book 177, Page 39, Register’s Office, Cumberland County, Tennessee.
This being the same property as in indicated on Tax Map 010.00 Parcel 018.00 in the records of the Tax Assessor of Cumberland County, Tennessee. The last and previous conveyance being recorded in Deed Book D491 Page 706 -707 in the Register of Deeds Office for Cumberland County, Tennessee.
In the deed which is of record in Deed Book D491, page 706-707, Register’s Office, Cumberland County, Tennessee, Bernice Clark conveyed to her daughter, Barbara Clark Rogers a remainder interest in the foregoing property. Bernice Clark died on the 29th day of May, 2016. Therefore, fee simple title is in the name of Barbara Clark Rogers subject only to the judgment liens described above.
Parcel 18.01 and Parcel 10.06 (This is a one-half Undivided Interest)
Property Address: Atkins Road, Crossville, Tn. and 118 Atkins Road, Crossville, Tn.
Barbara Clark Roger’s one-half undivided interest in the following described tract or parcel of land, lying and being in the SECOND CIVIL DISTRICT of Cumberland County, Tennessee, bounded and described as follows:
Tract No. 1: Beginning at an iron stake in the South right-of-way of a gravel road and being Bernice Clark’s Northeast corner; thence with said Clark’s East boundary line South 17 degrees 15’ West 559 feet to an iron stake in the South boundary line of the original tract of which this is a part; thence with said line South 81 degrees 30’ East 277 Feet to an iron stake; thence North 4 degrees East 560 feet to an iron stake in the South right-of-way of a gravel road; thence with said right-of-way North 84 degrees 15’ West 150 feet to the BEGINNING, containing 2.74 acres, more or less.
This being the same property as is indicated on Map 010 Parcel Number 18.01 in the records of the Tax Assessor of Cumberland County, Tennessee.
Tract No. 2: Beginning at an iron stake in the south right-of-way of a gravel road and being Ambrose Cole’s Northeast corner of his 2.74 acre tract of land; thence with the East boundary line of said tract South 4 degrees West 560 feet to an iron stake in the South boundary line of the original tract of which this is a part; thence with said line South 81 degrees 30’ East 150 feet to an iron stake; thence North 4 degrees east 567 feet to an iron stake in the South right-of-way of a gravel road; thence with said right-of-way North 84 degrees 15’ West 150 feet to the BEGINNING, containing 1.94 acres more or less.
This being the same property as is indicated on Map 010 Parcel Number 18.01 and 18.06 in the records of the Tax Assessor of Cumberland County, Tennessee.
Tract No. 3: Beginning at an iron stake in the South right-of-way of a gravel road, Ambrose Cole’s Northeast corner, thence with said Ambrose Cole East boundary line South 4 degrees West 567 feet to an iron stake in the South boundary line of the original tract of which this is a part; thence with said line South 81 degrees 30’East 150 feet to a stake; thence North 4 degrees East 574 feet to an iron stake in the South right-of-way of a gravel road; thence with said right-of-way North 84 degrees 15’ West 150 feet to the BEGINNING, containing 1.96 acres, more or less.
This being the same property as is indicated on Map 010 Parcel Number 18.06 in the records of the Tax Assessor of Cumberland County, Tennessee.
The last and previous conveyance of Tracts 1, 2 and 3 being recorded in Deed Book 1001 Page 1984 in the Register of Deeds Office for Cumberland County, Tennessee.
The last and previous conveyance being recorded in Deed Book 267, Page 868 in the Register of Deeds Office for Fentress County, Tennessee. The last and previous conveyance being recorded in Deed Book D491 Page 706 -707 in the Register of Deeds Office for Cumberland County, Tennessee.
THE PROPERTY TO BE SOLD IS THE ONE-HALF UNDIVIDED INTEREST OF BARBARA CLARK ROGERS ONLY. THE REMAINING ONE-HALF INTEREST WILL NOT BE SOLD.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property: Phillip A. Clark owns the remaining one-half undivided interest.
The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above.
