NOTICE OF MORTGAGE FORECLOSURE

ST. CLAIR COUNTY

Default having been made in the payment of the indebtedness of the note secured by mortgage on the hereinafter described lands of JAMES ELLISON, JR., to the undersigned mortgagee and owner of said mortgage, CLEVELAND FARMS, INC., and default continuing, the undersigned mortgagee and owner of said mortgage will sell for cash in front of the courthouse door of St. Clair County, Alabama, at Ashville, to the highest bidder on the 29th day of November, 2017, at 12:00 Noon, the following described property:

Lot 4 of Mountain Ridge Subdivision, according to the plat thereof recorded in Map Book 5, page 56, in the Probate Office of St. Clair County, Ashville, Alabama.

This property will be sold on an "As Is, Where Is" basis, subject to any easements, encumbrances, and exceptions reflected in the Mortgage and those contained in the records of the Office of the Judge of Probate of St. Clair County, Alabama. This property will be sold without warranty or recourse, expressed or implied as to title, use and/or enjoyment and will be sold subject to the right of redemption of all parties entitled thereto. This sale is made for the purpose of paying the indebtedness secured by said mortgage as well as the expenses of foreclosure. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.

The proceeds of said sale will be distributed as provided under the terms of the said mortgage, which mortgage is recorded in the office of the Judge of Probate of St. Clair County, Alabama, at Ashville, in Volume 1999, Page 629.
